TERMS & CONDITIONS North Sydney Bus Charters

By placing a booking with North Sydney Bus Charters Pty Ltd, the Hirer acknowledges that they have read, understood and agree to accept the Terms and Conditions as detailed below.

All bookings and quotes are subject to the following Terms & Conditions.

In the following terms and conditions, ‘the Company’ refers to NORTH SYDNEY BUS CHARTERS PTY LTD, its subsidiaries, brands or identities under which the company may trade, ‘the Customer’ and/or ‘the Hirer’ refers to the person and/or organisation making the booking and ‘the Driver’ refers to the driver or drivers of the coach, the coach operator or supplier of the vehicle.

1. Application of Terms

North Sydney Bus Charters Pty Ltd is a part of the NSBC Group Pty Ltd. They provide ground transport services throughout New South Wales and the ACT via the combined fleets of North Sydney Bus Charters, Bankstown Coaches, Canberra Coaches, Voyager Coaches, Mona Vale Coaches, Sydney Super Shuttle, Concord Coaches, Eastern Suburbs Bus Charters, Bondi Bus Charters and other partner operators.

Your booking is accepted subject to the following terms and conditions and by confirming your booking you accept that these terms & conditions will apply. These conditions apply whether a contract has been made verbally or in writing. The Hirer acts on behalf of all the passengers travelling on the vehicles. If the Hirer is a company, group, or partnership, an individual must be named as a responsible person.

The Hirer is responsible for the actions and decisions of all the passengers on board including any additional costs incurred in performing the contract, whether or not they actually travel with the party. If the Hirer is not going to travel with the party, a representative must be chosen, and the company informed prior to the hire taking place. The company will only accept instructions from the Hirer or their nominated representative.

2. Quotations

Quotations are given on the basis of the direct route and on information provided by the Hirer. The route used will be at the discretion of North Sydney Bus Charters unless it has been particularly specified by the Hirer in which case it will be clearly shown on the confirmation. All quotations are given subject to the company having available a suitable vehicle at the time the Hirer accepts the quotation.

Quotations are valid for 14 days unless otherwise notified.

Quotations are given for one coach and one driver only (unless specified) and excludes any road toll charges, unless stated on the quotation. Any additional charges will be separately identified and will be the Hirer’s responsibility unless otherwise specified. North Sydney Bus Charters reserves the right to change quotations at any time within the 14-day period provided that a booking has not been confirmed by both parties in writing and a deposit has not been made to secure the booking.

3. Route and Time Variation

The company reserves the right to levy additional charges for additional mileage or time to that which has already been agreed. The charges will be pro rata and in accordance with the formula used for the original booking confirmation. The vehicle will depart at times agreed by the Hirer, and it is the responsibility of the Hirer to account for all passengers at those times. North Sydney Bus Charters will not accept liability for any losses incurred by passengers who fail to follow instructions given by the Hirer.

a) Additional Charges for Route or Time Variation

When, at the request of the Hirer, any change in service resulting in additional kilometres or hours to that specified on the booking confirmation, an additional charge shall be made for such additional services. Tolls, vehicle entry fees & parking fees, etc. will be separate and additional elements in the determination of any additional charges.

North Sydney Bus Charters will notify the Hirer of any additional charges that may be expected to be incurred at the time of the original booking confirmation. Any additional fees unforeseen prior to the departure of the charter are the responsibility of the Hirer. The Hirer is responsible for allocating a safe and legal pick up point.

b) Waiting Time

The driver will wait for a maximum of 30 minutes after the scheduled time of pick up. Should the driver wait for longer than 30 minutes after the scheduled pick up time, North Sydney Bus Charters reserves the right to charge the Hirer a late arrival fee at the discretion of the Company.

4. Drivers’ Hours & Fatigue

The hours of operation for the driver are regulated by law, and the Hirer accepts the responsibility of ensuring they keep to the hours and times agreed by North Sydney Bus Charters.

Neither the Hirer nor any passengers shall delay or otherwise interrupt the journey in such a way that the driver is at risk of breaching regulations relating to driving hours and duty time. If any breach is likely to occur, the Hirer will be responsible for any additional costs incurred unless it is outside the control of the Hirer.

5. Seating Capacity

North Sydney Bus Charters will, at the time of booking, agree and specify the legal seating capacity of the vehicle to be supplied. The Hirer must not load the vehicle beyond this capacity. When the Hirer books a known number of passengers on a multiple vehicle charter, the company reserves the right to supply vehicles of different capacity and adjust the quantity of vehicles to carry the agreed number of passengers. This will depend on vehicle availability on the day.

6. Confirmation

Written confirmation by North Sydney Bus Charters is the only basis for the acceptance of a hire or for a subsequent alteration to its terms.

7. Payment

Any deposit requested must be paid to secure the booking, and the balance must be made before the start of the hire unless otherwise agreed by North Sydney Bus Charters. A credit account may be set up with the accounts department subject to the full discretion of the company.  

North Sydney Bus Charters reserves the right to cancel your booking without refund should payment not be made within 24 hours unless otherwise agreed to. North Sydney Bus Charters reserves the right to amend the price of a booking should full payment have not been made by the customer prior to the 24-hour limit. Please note that deposits are non-refundable.

8. Cancellation by Hirer

In an event that you cancel your booking. North Sydney Bus Charters reserves the right to charge a cancellation fee as follows:

  • Bookings cancelled greater than 25 hours of departure: No loss
  • Bookings cancelled within 24 hours and 6 hours prior of departure: 50% of the value of the booking
  • Within 6 hours prior to departure – 100% of total value of the booking
  • If coaches/buses arrive at the pickup location/boarding point and are not required and have not been cancelled, the full amount will be invoiced as per the booking

 

All cancellations will only be accepted in writing by emailing info@northsydneybuscharters.com.au

If a driver arrives at the specified pick up location and is directed to a different address, North Sydney Bus Charters has the right to cancel the booking and provide no refund if the alternate address is deemed unacceptable to North Sydney Bus Charter staff.

In the event a credit note is issued, the credit voucher is not transferable.

9. Changes to Bookings

Changes can be made to your charter can be done so 24 hours prior to departure and can include the following categories include changes to the time, date, place of departure and destination.

You may change your booking in writing to info@northsydneybuscharters.com.au, up to 24 hours prior to departure.

Changes to pick up locations outside of a 5km radius may incur extra service charges.

Changes cannot be made to a booking where your service has arrived after your original scheduled departure time.

10. Refund Policy

Refunds, where appropriate will be processed onto the card that payment has been made on, or via EFT funds transfer. Please note refunds can take up to 5 working days to appear in your account. Please refer to section 10. Cancellation by the Hirer, for scales of charges that apply when cancelling your booking.  Please note that deposits are non-refundable.

11. Cancellation by the Company

In the event of any emergency, riot, civil commotion, strike, stoppage or restraint of labour or on the happening of any event over which the company has no control [including adverse weather and road conditions] or in the event of the Hirer taking any action to vary agreed conditions North Sydney Bus Charters will take all reasonable measures to provide a replacement or alternative solution.

If this is not possible, North Sydney Bus Charters retains the right to return all monies paid and, without liability, cancel the booking providing the Hirer with as much notice as possible.

In such circumstance, North Sydney Bus Charters shall have no liability for any inconvenience or loss incurred and will not be liable for any direct or consequential loss howsoever arising. It is strongly recommended that the Hirer should consider insuring against this risk.

12. Credit Card Charges

In the event of payment via credit card, North Sydney Bus Charters will charge an additional fee of up to 1.50% for VISA and Mastercard and up to 3% for American Express cards of the value of the booking according to the type of credit card used.

13. Vehicle to be Provided

North Sydney Bus Charters reserves the right to provide a larger vehicle than that specified at no additional charge.

North Sydney Bus Charters reserves the right to substitute another vehicle, including those of other operators, for all or part of the hire subject to such substitutes being of equal or greater quality.

14. Breakdown and Delays

North Sydney Bus Charters gives advice on journey times in good faith and does not guarantee the completion of any journey in any exact time and will not be liable for loss or inconvenience caused by the actual journey time and or breakdown of the hire vehicle.

The time of arrival at the starting point, stop-over point, destination, or return to point of origin cannot be guaranteed. All North Sydney Bus Charters drivers are preselected and have instructions to drive at all times in compliance to all governing laws. Hirers cannot drive our vehicles.

Unusual road, traffic and weather conditions are beyond the control of North Sydney Bus Charters and the driver, and delays will not be the responsibility of North Sydney Bus Charters or the driver. Late arrivals due to these and other occurrences out of the control of the driver are not grounds for cancellation of the charter.

The driver makes the final decision for the route taken based on time of day, day of the week, road works or knowledge of street delays due to accidents or other unforeseen occurrences.

Any late arrivals at your destination from taking of such routes are not cause for refunds, partial refunds or compensation in any way and the liability is limited to the value of the charter.

15. Food & Beverage Consumption

We allow food and beverages to be carried and consumed on the vehicle subject to the following restrictions:

  • no hot food or hot drinks are to be taken on board any vehicle;
  • no glass bottles will be allowed on board a vehicle;
  • all drinks must be in plastic or non breakable receptacles; and
  • alcoholic beverages are not permitted on the vehicle and may not be consumed on board a vehicle.

16. Conduct of Passengers

Whilst North Sydney Bus Charters will take all reasonable measures to ensure the safety of all passengers, passengers travel at their own risk.

Passengers should remain seated at all times and put on their seat belts (where fitted)

The driver is responsible for the safety of the vehicle. Any passenger whose conduct is in breach of statutory regulations may be removed from the vehicle or prevented from boarding on the driver’s authority. The Hirer will be responsible for the conduct of passengers and for any damage caused to the vehicle by passengers during the hire.

North Sydney Bus Charters reserves the right to charge the Hirer for any damage caused during the course of any hire. (including that from intoxicated passengers)


No Smoking, including e-cigarettes is permitted in any of our vehicles. It is against the law in NSW to smoke in a Public Transport Vehicle. Smokers must be at least 4 metres away from the vehicle at all times.

The driver reserves the right to refuse to transport persons under the influence of intoxicating liquor or drugs, or who are, or are likely to become objectionable to other persons inside or outside the vehicle. If there is unsociable or unruly behaviour on or off the vehicle at any time, the driver has the right to terminate the charter immediately and if necessary, call the police.

Any unruly or overly intoxicated passenger may be refused entry to the bus should the driver feel that he or she may behave poorly, become sick or abusive.

North Sydney Bus Charters shall not be liable for any loss or inconvenience caused by the termination of its service due to unruly behaviour.

The Hirer is responsible for the cost of repairs resulting from any damage caused to the vehicle by any members of the hiring party, during the charter or hiring of the vehicle and is payable as soon as such cost is determined.

The company will not accept any liability for damage, injury or loss for any passenger out of their seat, standing up or walking around the vehicle whilst in motion.

17. Luggage & Valuables

The Hirer or its representative is responsible for all luggage, carry-on luggage and personal items brought onboard. We accept no responsibility and will not be liable for any damage to (unless the damage was caused by our negligence at no fault by the passenger), theft or loss of any luggage or personal items whilst on our premises including when on board a vehicle.

We will make every reasonable attempt to lock our luggage compartments and buses.

a) prohibited items

We may refuse carriage of any luggage or personal items if we reasonably believe that the item is:

  • unsafe;
  • a hazardous substance or dangerous good;
  • likely to be damaged during travel; or
  • likely to cause damage to other passengers or any other property

 

In the event we refuse to carry any personal items, the Hirer holds sole responsibility for all costs of alternate travel for those items.

b) lost property

If a passenger leaves an item or luggage on one of our vehicles:

  • We will make all reasonable efforts to identify the owner of the item and notify them of the unclaimed item. Collection of the item will be the sole responsibility of the passenger
  • Any freight fees incurred in transporting the lost item to an alternate location will be the owners responsibility
c) unclaimed items
  • We will store the item as lost property for a period of 30 days. Should the item remain unclaimed at the expiry of that storage period, the item will be disposed of at our sole discretion
  • We will not be liable for any loss, expense or inconvenience incurred by the passenger

18. Damages

If any damage has been caused by passengers the “company” will carry out the necessary repairs and the bill will be responsibility of the organizing individual. The “company” will not be held responsible for any damage caused intentionally or otherwise to people or property/venues and the passengers and/or organiser will be held liable to cover any additional costs incurred.

19. Right to Refuse Travel

We reserve the right to refuse travel or remove from the vehicle any passenger:

  • behaves in a disruptive, threatening or unlawful manner and may pose a threat to themselves, other passengers, North Sydney Bus Charters staff or property
  • on our reasonable assessment, appears to be under the influence of alcohol or any other drug or appears to be in possession of any unlawful substance
  • records a temperature of more than 37.5 degrees when a temperature check is conducted by North Sydney Bus Charters staff
  • is afflicted by an infectious disease that poses risks to other passengers
  • is observed smoking or attempting to smoke a cigarette (or e-cigarette) on board a vehicle, including any onboard toilet facility
  • cannot prove you are the person connected with the Hirer who made the booking
  • fails to comply with any applicable laws, rules, regulation or order
  • has previously breached our Terms and Conditions; or
  • fails to comply with these Terms and Conditions

20. Complaints

In the event of complaint about North Sydney Bus Charters services, the Hirer should endeavour to seek a solution at the time by seeking assistance from the driver or from the company. If this has not provided a remedy, complaints should be submitted in writing and within 5 days of the completion of the hire. North Sydney Bus Charters will acknowledge all complaints within 7 days and will normally reply fully within 14 days.

21. Enforceability

If any provision or term of these Terms and Conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be deleted but all other terms will remain valid.

22. Australian Law

These terms and Conditions together with any Booking Confirmation shall be subject to and construed in accordance with the laws of Australia.

23. Privacy

By either registering your email through our systems or as a result of filling in a quotation and/or placing a booking, you also agree to receive relevant marketing information from North Sydney Bus Charters.

24. Photos

Please be aware that any photos taken aboard our buses may be used for marketing or advertising and/or for security purposes, they remain the property of the NSBC Group and will not be sold or distributed without the company’s consent.

25. General Conditions

We pride ourselves in the knowledge that we offer the very best in customer service satisfaction; however there may be times, due to an act outside of our control, where we fail to deliver the highest quality of service. If this happens please let management know and we will make every endeavor to rectify the problem.

In the event a customer cannot be located for whatever reason, to avoid any inconvenience to fellow customers, our drivers have been instructed to continue on with their journey. We will try to accommodate the customer on the next available service. If for any reason there is a misunderstanding between the driver and the customer and after discussing it with office management and we feel the customer has been inconvenienced, we will endeavor to reimburse the customer accordingly.

Please note that it is under the discretion of the driver to sometimes arrive 15-20 minutes earlier than stated when your pickup time is confirmed. This can be due to traffic conditions, accidents, etc. It is your responsibility to be ready 15 – 30 minutes prior to pick up time. If you are not ready when the driver arrives, we cannot guarantee that they can take you to your destination on time and a refund will not be given for late arrivals.
